Terms & Conditions

1. About these Terms

These Terms & Conditions (“Terms”) are the agreement between you and YouCoach (“we”, “us”, “our”), based in South Africa. They apply to our website (youcoach.co.za), the YouCoach app at app.youcoach.co.za, and the emails and notifications we send. Together we call these “the Service”.

By using the Service, you agree to these Terms. If you do not agree with any part of them, please do not use the Service.

2. Who can use YouCoach

You must be 13 or older to use the Service. By using it, you confirm that you are.

If you are under 18, you may only use the Service with the permission of a parent or guardian, who agrees to these Terms on your behalf.

3. Your account

4. Coaching, not medical care

YouCoach is a wellness and habit coaching tool. It is not medical advice, and it is not a medical, psychological or emergency service. Nothing in the Service, including anything a coach tells you, replaces advice from a qualified health professional.

Talk to your doctor or another qualified professional before you start a new exercise, diet or health routine, or if you are worried about your health. Please make your own decisions about your health and wellbeing.

In an emergency, do not use YouCoach. Call your local emergency services. In South Africa, dial 112 from a cellphone.

5. Your content

The goals, activities, journal entries, photos and messages you add to YouCoach belong to you. You give us permission to store and display them only as needed to provide the Service to you, for example to show your progress to the coach you have linked with, as our Privacy Policy explains.

You are responsible for what you add. Only share other people's personal information or photos if you have the right to.

6. Using YouCoach fairly

When you use the Service, please do not:

7. Beta and pricing

YouCoach is currently in beta and free to use. Because it is still being built, features may change, be added or be removed. If we ever plan to charge for the Service, we will tell you well before any charge applies, and you will be able to choose whether to continue.

8. Privacy

Your use of the Service is also covered by our Privacy Policy, which explains what information we collect, how we use it and your rights. Please read it before using the Service.

The Service may link to websites or services that we do not own or control. We are not responsible for their content, privacy policies or practices, and we are not liable for any loss or damage caused by your use of them. Please read their terms and privacy policies.

10. Ending your use

You can stop using the Service and delete your account at any time.

We may suspend or close your account, without notice, if you break these Terms or if we need to in order to protect other users or the Service. When your account is closed, your right to use the Service ends.

11. Limitation of liability

To the maximum extent the law allows, our total liability to you under these Terms is limited to the amount you actually paid us through the Service, or 100 US dollars (or the equivalent in South African rand) if you have not paid anything.

To the maximum extent the law allows, we and our suppliers are not liable for any special, incidental, indirect or consequential damages. This includes loss of profits, loss of data, business interruption, personal injury or loss of privacy arising from your use of, or inability to use, the Service, even if we were told such damage was possible.

Nothing in these Terms limits any rights you have under South African law, including the Consumer Protection Act, 2008, that cannot legally be limited or excluded.

12. “As is” and “as available”

We work hard to keep the Service running well, but we provide it “as is” and “as available”, with all faults and without warranties of any kind, to the maximum extent the law allows. We do not promise that the Service will meet your needs, achieve any particular result, work with other software, be available without interruption, or be free of errors, viruses or other harmful components.

Some laws do not allow some of these exclusions. Where that is the case, they apply only as far as the law allows.

13. Governing law and disputes

These Terms and your use of the Service are governed by the laws of South Africa. If you have a concern or dispute, please first contact us so we can try to resolve it informally.

If you live in the European Union, you also benefit from any mandatory protections of the law of the country where you live.

15. Changes to these Terms

We may change these Terms from time to time. If a change is important, we will give you at least 30 days' notice by email or in the app before it takes effect. If you keep using the Service after a change takes effect, you agree to the new Terms. If you do not agree, please stop using the Service.
